US Judge Mandates Freedom of Abrego Garcia from Immigration Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks lawful basis.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling allegations, he was detained in federal custody.
In her decision, the court noted that the authorities lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "for now."
Background of the Case
The court proceedings center on disputed claims. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing criminal case in the state of Tennessee.
Terms of Release
The judge, who was overseeing his petition to removal in a Maryland district court, determined that he must now adhere to the terms of his release from jail in Tennessee. This decision shifts his supervision to the Tennessee court.
This ruling represents a notable turn in a complicated immigration battle involving allegations of wrongful detention and contested gang associations.
